The European Intellectual Property Office (EUIPO) is increasingly relying on mediation to resolve disputes over intellectual property rights efficiently and constructively.
To strengthen and develop the skills of its internal mediators, the EUIPO organized a mock mediation training course lasting several days.
The aim of this training was to provide mediators with a practical training platform where they could test their skills on realistic case studies and develop them further through individual feedback.

The challenge

The biggest challenge was to deliver an effective online training course with a well-coordinated international team of trainers with different qualifications and English language skills.
The training schedule was meticulously planned to enable a smooth transition between plenary and small groups, with six trainers working simultaneously to supervise the small groups.
Each participant took on the role of mediator and received individual written feedback afterwards with specific tips for personal development.

Result

The feedback from the participants was extremely positive, as they felt their skills had been strengthened by the training and benefited from the individual support in the small groups.
This was also reflected in the successful implementation of the training in 2023 and the winning of another tender in 2024.

Effects

The increased competence and procedural reliability of mediators has a direct impact on the acceptance of mediation as an alternative to other procedures and contributes to increasing the settlement rate.
In 2023, the EUIPO was able to introduce a mediation center and since then has increasingly relied on mediation as an integral part of its procedural offerings.
